Pat Down, Take Down

Kentucky Republican Sen. Rand Paul told The Daily Caller that being “detained” by the Transportation Security Administration at the Nashville airport Monday was a major ordeal that underscores flaws in TSA’s procedures that affect tens of millions of passengers every year.

“It was a big headache,” Paul said in a phone interview. “I missed my speech here. I was supposed to speak to the Right to Life March, probably the biggest audience I’ll get to speak to, and I missed it.”

The White House, through spokesman Jay Carney, defended the TSA’s actions during Monday’s press briefing by arguing that Paul wasn’t technically “detained.”
“Let’s be clear,” Carney said. “The passenger was not detained. He was escorted out of the area by local law-enforcement.”

[No, Mr. Carney, if law enforcement stop you and you are not able to leave - you are being detained.  You are wrong as is the White House.]


But Sen. Paul told TheDC that he certainly felt like he was detained. “If you’re told you can’t leave, does that count as detention?” Paul asked.
“I tried to leave the cubicle to speak to one of the TSA people and I was barked at: ‘Do not leave the cubicle!’ So, that, to me sounds like I’m being asked not to leave the cubicle. It sounds a little bit like I’m being detained.”

The incident started after the scanner Paul walked through sounded its alarm. Current TSA rules would require Paul to undergo a mandatory pat-down before proceeding to his plane. But Paul told TheDC that the TSA agents caved in after a two-hour battle and allowed him to go through the scanner again without additional physical screening.
 “For an hour and a half, they said ‘absolutely, I would have to [accept a pat-down],’” Paul said. “And, because I used my cell phone, they told me I would have to do a full body pat down because you’re not allowed to use your cell phone when you’re being detained.”

“It’s like, well, I can’t call my attorney? I can’t call my office to tell them I’m going to miss a speech to 200,000 people?”

“In the end, after two hours of this quarreling,” Sen. Paul explained, “they did let me walk through the screener [machine] and it didn’t go off. So what the TSA is not telling you is the screeners are being used as random devices as well. The [mechanical] screeners will go off randomly, and the [agent] screeners don’t know that it’s a random call but it has nothing to do with what you’ve done.”

Paul doesn’t think the Nashville TSA agents were singling him out because he has been critical of the agency.

“I don’t think so,” Paul said. “They’ve usually treated me pretty well in Nashville. But the problem is the rules that are coming out of Washington. We’ve been 10 years and we have no frequent flier program, we have no ability for people to go back through the screener, [and] one-size-fits-all, everybody-is-a-potential-terrorist rules waste a lot of time on people who are not terrorists.

“So, resources, I think, could be better devoted to looking at who’s flying and where they’ve been flying and knowing more about the passenger list rather than spending all this time doing these random screenings of elderly people, young people and frequent fliers.”

Paul has dueled with TSA administrator John Pistole during Senate hearings about why travelers are required to consent to mandatory full body pat downs if scanners beep when they walk through. Paul argues that passengers should be allowed to choose to go through the scanners again rather than being forced to undergo a physical pat-down.

“The TSA has got a lot of problems,” Paul told TheDC. “There are a lot of people who are insulted and their dignity is compromised by what the TSA does to them. Really all I’m asking for is when you go through the screener [machine], you ought to be allowed to choose to get a body pat-down or choose to go back through the screener.”

TSA procedures, he said, ultimately waste time and resources. “So, if you try to comply, if you take your shoes off, you take your glasses off, you take your wallet out, you take everything out of your pockets and try to comply, it still goes off randomly.”

“But then you’re made to think that, ‘Oh, there’s a problem. We have to look at this,’” Paul said. “But, they’re wasting time, I think, by doing this. Instead of targeting people who meet a risk profile for terrorism, what they’re doing is they’re just doing these random things. But, I think it’s a waste of time and it’s insulting to put people through a body pat down when they have not shown any risk.”

“I think every American should be allowed to go back through the screener if they don’t choose to have a pat-down,” Paul insisted.

Washington, D.C. - Department of Homeland Security (DHS) Secretary Janet Napolitano today announced the expansion of the Department's national "If You See Something, Say Something" campaign to hundreds of Walmart stores across the country - launching a new partnership between DHS and Walmart to help the American public play an active role in ensuring the safety and security of our nation.

"Homeland security starts with hometown security, and each of us plays a critical role in keeping our country and communities safe," said Secretary Napolitano. "I applaud Walmart for joining the ‘If You See Something, Say Something' campaign. This partnership will help millions of shoppers across the nation identify and report indicators of terrorism, crime and other threats to law enforcement authorities."

The "If You See Something, Say Something" campaign—originally implemented by New York City's Metropolitan Transportation Authority and funded, in part, by $13 million from DHS' Transit Security Grant Program—is a simple and effective program to engage the public and key frontline employees to identify and report indicators of terrorism, crime and other threats to the proper transportation and law enforcement authorities.

More than 230 Walmart stores nationwide launched the "If You See Something, Say Something" campaign today, with a total of 588 Walmart stores in 27 states joining in the coming weeks. A short video message will play at select checkout locations to remind shoppers to contact local law enforcement to report suspicious activity.

Over the past five months, DHS has worked with its federal, state, local and private sector partners, as well as the Department of Justice, to expand the "If You See Something, Say Something" campaign and Nationwide SAR Initiative to communities throughout the country—including the recent state-wide expansions of the "If You See Something, Say Something" campaign across Minnesota and New Jersey. Partners include the Mall of America, the American Hotel & Lodging Association, Amtrak, the Washington Metropolitan Area Transit Authority, sports and general aviation industries, and state and local fusion centers across the country.

DHS (ICE) Seize Website Domain Names

One question might be - if Congress is considering an act authorizing action on internet infringement, I have to wonder, by what authority are they seizing these sites (I am sure there must be authority or they would not do it).

The investigative arm of the Homeland Security Department appears to be shutting down websites that facilitate copyright infringement.

Immigration and Customs Enforcement (ICE) has seized dozens of domain names over the past few days, according to TorrentFreak.

ICE appears to be targeting sites that help Internet users download copyrighted music, as well as sites that sell bootleg goods, such as fake designer handbags.

The sites are replaced with a note from the government: "This domain named has been seized by ICE, Homeland Security Investigations."

For instance, 2009jersey.com, 51607.com, and amoyhy.com have each been seized.

One of the site owners told TorrentFreak that his site was shut down without any notice or warning.

The effort come as Congress considers the Combatting Online Infringement and Counterfeits Act (COICA). Critics, including Sen. Ron Wyden (D-Ore.) say it is too heavy-handed. He has vowed to put a formal hold on the bill.

DHS: We don't Like Color Coded System

The color coded warning system, and the new claim as to why it needs to be done away with ...

This is good to keep because it can be juxtaposed against what they do create ...


Perhaps they should do a warning color system for us - what we can expect at the airport:  Green - regular check, pat, and adios.  Yellow - stand like a cross, wand waved about, patted down.  Red:  armed guards, scanner, x-ray, backscatter, and groping.

TSA and their unproductive, violative, idiotic, unjust, dubious actions

This guys story is well worth the time.  Can I not fly - I really really want to go somewhere during Christmas break and in summer, but will make do, here.  They win - I won't fly.  The airlines will lose money, they will ask the federal government for bailout, the government will be hard pressed to explain why they paid for machines that resulted in the airlines losing money they had to give them to keep them from failing. 

All because of intransigent fools who are placed in charge of agencies they are wholly unqualified to head.

While we are at it, abolish the TSA.  Incompetents, many of whom arrived here from a small country far away or a big country just as far away, some are illegals, and others just not the brightest bunch - abolish the TSA, save us all money and do away with this insane screening process.  Use a method that is very nearly full-proof - and it isn't an x-ray machine.

These events took place roughly between 5:30 and 6:30 AM, November 13th in Terminal 2 of the San Diego International Airport. I'm writing this approximately 2 1/2 hours after the events transpired, and they are correct to the best of my recollection. I will admit to being particularly fuzzy on the exact order of events when dealing with the agents after getting my ticket refunded; however, all of the events described did occur.

This morning, I tried to fly out of San Diego International Airport but was refused by the TSA. I had been somewhat prepared for this eventuality. I have been reading about the millimeter wave and backscatter x-ray machines and the possible harm to health as well as the vivid pictures they create of people's naked bodies. Not wanting to go through them, I had done my research on the TSA's website prior to traveling to see if SAN had them. From all indications, they did not. When I arrived at the security line, I found that the TSA's website was out of date. SAN does in fact utilize backscatter x-ray machines.


I made my way through the line toward the first line of "defense": the TSA ID checker. This agent looked over my boarding pass, looked over my ID, looked at me and then back at my ID. After that, he waved me through. SAN is still operating metal detectors, so I walked over to one of the lines for them. After removing my shoes and making my way toward the metal detector, the person in front of me in line was pulled out to go through the backscatter machine. After asking what it was and being told, he opted out. This left the machine free, and before I could go through the metal detector, I was pulled out of line to go through the backscatter machine. When asked, I half-chuckled and said, "I don't think so." At this point, I was informed that I would be subject to a pat down, and I waited for another agent.


A male agent (it was a female who had directed me to the backscatter machine in the first place), came and waited for me to get my bags and then directed me over to the far corner of the area for screening. After setting my things on a table, he turned to me and began to explain that he was going to do a "standard" pat down. (I thought to myself, "great, not one of those gropings like I've been reading about".) After he described, the pat down, I realized that he intended to touch my groin. After he finished his description but before he started the pat down, I looked him straight in the eye and said, "if you touch my junk, I'll have you arrested." He, a bit taken aback, informed me that he would have to involve his supervisor because of my comment.


We both stood there for no more than probably two minutes before a female TSA agent (apparently, the supervisor) arrived. She described to me that because I had opted out of the backscatter screening, I would now be patted down, and that involved running hands up the inside of my legs until they felt my groin. I stated that I would not allow myself to be subject to a molestation as a condition of getting on my flight. The supervisor informed me that it was a standard administrative security check and that they were authorized to do it. I repeated that I felt what they were doing was a sexual assault, and that if they were anyone but the government, the act would be illegal. I believe that I was then informed that if I did not submit to the inspection, I would not be getting on my flight. I again stated that I thought the search was illegal. I told her that I would be willing to submit to a walk through the metal detector as over 80% of the rest of the people were doing, but I would not be groped. The supervisor, then offered to go get her supervisor.


I took a seat in a tiny metal chair next to the table with my belongings and waited. While waiting, I asked the original agent (who was supposed to do the pat down) if he had many people opt out to which he replied, none (or almost none, I don't remember exactly). He said that I gave up a lot of rights when I bought my ticket. I replied that the government took them away after September 11th. There was silence until the next supervisor arrived. A few minutes later, the female agent/supervisor arrived with a man in a suit (not a uniform). He gave me a business card identifying him as David Silva, Transportation Security Manager, San Diego International Airport. At this point, more TSA agents as well as what I assume was a local police officer arrived on the scene and surrounded the area where I was being detained. The female supervisor explained the situation to Mr. Silva. After some quick back and forth (that I didn't understand/hear), I could overhear Mr. Silva say something to the effect of, "then escort him from the airport." I again offered to submit to the metal detector, and my father-in-law, who was near by also tried to plead for some reasonableness on the TSA's part.


The female supervisor took my ID at this point and began taking some kind of report with which I cooperated. Once she had finished, I asked if I could put my shoes back on. I was allowed to put my shoes back on and gather my belongs. I asked, "are we done here" (it was clear at this point that I was going to be escorted out), and the local police officer said, "follow me". I followed him around the side of the screening area and back out to the ticketing area. I said apologized to him for the hassle, to which he replied that it was not a problem.


I made my way over to the American Airlines counter, explained the situation, and asked if my ticket could be refunded. The woman behind the counter furiously typed away for about 30 seconds before letting me know that she would need a supervisor. She went to the other end of the counter. When she returned, she informed me that the ticket was non-refundable, but that she was still trying to find a supervisor. After a few more minutes, she was able to refund my ticket. I told her that I had previously had a bad experience with American Airlines and had sworn never to fly with them again (I rationalized this trip since my father-in-law had paid for the ticket), but that after her helpfulness, I would once again be willing to use their carrier again.


At this point, I thought it was all over. I began to make my way to the stairs to exit the airport, when I was approached by another man in slacks and a sport coat. He was accompanied by the officer that had escorted me to the ticketing area and Mr. Silva. He informed me that I could not leave the airport. He said that once I start the screening in the secure area, I could not leave until it was completed. Having left the area, he stated, I would be subject to a civil suit and a $10,000 fine. I asked him if he was also going to fine the 6 TSA agents and the local police officer who escorted me from the secure area. After all, I did exactly what I was told. He said that they didn't know the rules, and that he would deal with them later. They would not be subject to civil penalties. I then pointed to Mr. Silva and asked if he would be subject to any penalties. He is the agents' supervisor, and he directed them to escort me out. The man informed me that Mr. Silva was new and he would not be subject to penalties, either. He again asserted the necessity that I return to the screening area. When I asked why, he explained that I may have an incendiary device and whether or not that was true needed to be determined. I told him that I would submit to a walk through the metal detector, but that was it; I would not be groped. He told me that their procedures are on their website, and therefore, I was fully informed before I entered the airport; I had implicitly agreed to whatever screening they deemed appropriate. I told him that San Diego was not listed on the TSA's website as an airport using Advanced Imaging Technology, and I believed that I would only be subject to the metal detector. He replied that he was not a webmaster, and I asked then why he was referring me to the TSA's website if he didn't know anything about it. I again refused to re-enter the screening area.


The man asked me to stay put while he walked off to confer with the officer and Mr. Silva. They went about 20 feet away and began talking amongst themselves while I waited. I couldn't over hear anything, but I got the impression that the police officer was recounting his version of the events that had transpired in the screening area (my initial refusal to be patted down). After a few minutes, I asked loudly across the distance if I was free to leave. The man dismissively held up a finger and said, "hold on". I waited. After another minute or so, he returned and asked for my name. I asked why he needed it, and reminded him that the female supervisor/agent had already taken a report. He said that he was trying to be friendly and help me out. I asked to what end. He reminded me that I could be sued civilly and face a $10,000 fine and that my cooperation could help mitigate the penalties I was facing. I replied that he already had my information in the report that was taken and I asked if I was free to leave. I reminded him that he was now illegally detaining me and that I would not be subject to screening as a condition of leaving the airport. He told me that he was only trying to help (I should note that his demeanor never suggested that he was trying to help. I was clearly being interrogated.), and that no one was forcing me to stay. I asked if tried to leave if he would have the officer arrest me. He again said that no one was forcing me to stay. I looked him in the eye, and said, "then I'm leaving". The top-secret world the government created in response to the terrorist attacks of Sept. 11, 2001, has become so large, so unwieldy and so secretive that no one knows how much money it costs, how many people it employs, how many programs exist within it or exactly how many agencies do the same work.


These are some of the findings of a two-year investigation by The Washington Post that discovered what amounts to an alternative geography of the United States, a Top Secret America hidden from public view and lacking in thorough oversight. After nine years of unprecedented spending and growth, the result is that the system put in place to keep the United States safe is so massive that its effectiveness is impossible to determine.

The investigation's other findings include:


* Some 1,271 government organizations and 1,931 private companies work on programs related to counterterrorism, homeland security and intelligence in about 10,000 locations across the United States.

* An estimated 854,000 people, nearly 1.5 times as many people as live in Washington, D.C., hold top-secret security clearances.

* In Washington and the surrounding area, 33 building complexes for top-secret intelligence work are under construction or have been built since September 2001. Together they occupy the equivalent of almost three Pentagons or 22 U.S. Capitol buildings - about 17 million square feet of space.

* Many security and intelligence agencies do the same work, creating redundancy and waste. For example, 51 federal organizations and military commands, operating in 15 U.S. cities, track the flow of money to and from terrorist networks.

* Analysts who make sense of documents and conversations obtained by foreign and domestic spying share their judgment by publishing 50,000 intelligence reports each year - a volume so large that many are routinely ignored.

These are not academic issues; lack of focus, not lack of resources, was at the heart of the Fort Hood shooting that left 13 dead, as well as the Christmas Day bomb attempt thwarted not by the thousands of analysts employed to find lone terrorists but by an alert airline passenger who saw smoke coming from his seatmate.

They are also issues that greatly concern some of the people in charge of the nation's security.

"There has been so much growth since 9/11 that getting your arms around that - not just for the DNI [Director of National Intelligence], but for any individual, for the director of the CIA, for the secretary of defense - is a challenge," Defense Secretary Robert M. Gates said in an interview with The Post last week.

In the Department of Defense, where more than two-thirds of the intelligence programs reside, only a handful of senior officials - called Super Users - have the ability to even know about all the department's activities. But as two of the Super Users indicated in interviews, there is simply no way they can keep up with the nation's most sensitive work.

"I'm not going to live long enough to be briefed on everything" was how one Super User put it. The other recounted that for his initial briefing, he was escorted into a tiny, dark room, seated at a small table and told he couldn't take notes. Program after program began flashing on a screen, he said, until he yelled ''Stop!" in frustration.

"I wasn't remembering any of it," he said.

Underscoring the seriousness of these issues are the conclusions of retired Army Lt. Gen. John R. Vines, who was asked last year to review the method for tracking the Defense Department's most sensitive programs. Vines, who once commanded 145,000 troops in Iraq and is familiar with complex problems, was stunned by what he discovered.

"I'm not aware of any agency with the authority, responsibility or a process in place to coordinate all these interagency and commercial activities," he said in an interview. "The complexity of this system defies description."

The result, he added, is that it's impossible to tell whether the country is safer because of all this spending and all these activities. "Because it lacks a synchronizing process, it inevitably results in message dissonance, reduced effectiveness and waste," Vines said. "We consequently can't effectively assess whether it is making us more safe."

The Post's investigation is based on government documents and contracts, job descriptions, property records, corporate and social networking Web sites, additional records, and hundreds of interviews with intelligence, military and corporate officials and former officials. Most requested anonymity either because they are prohibited from speaking publicly or because, they said, they feared retaliation at work for describing their concerns.

The Post's online database of government organizations and private companies was built entirely on public records. The investigation focused on top-secret work because the amount classified at the secret level is too large to accurately track.

Defense Secretary Gates, in his interview with The Post, said that he does not believe the system has become too big to manage but that getting precise data is sometimes difficult. Singling out the growth of intelligence units in the Defense Department, he said he intends to review those programs for waste. "Nine years after 9/11, it makes a lot of sense to sort of take a look at this and say, 'Okay, we've built tremendous capability, but do we have more than we need?' " he said.

CIA Director Leon Panetta, who was also interviewed by The Post last week, said he's begun mapping out a five-year plan for his agency because the levels of spending since 9/11 are not sustainable. "Particularly with these deficits, we're going to hit the wall. I want to be prepared for that," he said. "Frankly, I think everyone in intelligence ought to be doing that."

In an interview before he resigned as the director of national intelligence in May, retired Adm. Dennis C. Blair said he did not believe there was overlap and redundancy in the intelligence world. "Much of what appears to be redundancy is, in fact, providing tailored intelligence for many different customers," he said.

Blair also expressed confidence that subordinates told him what he needed to know. "I have visibility on all the important intelligence programs across the community, and there are processes in place to ensure the different intelligence capabilities are working together where they need to," he said.

Weeks later, as he sat in the corner of a ballroom at the Willard Hotel waiting to give a speech, he mused about The Post's findings. "After 9/11, when we decided to attack violent extremism, we did as we so often do in this country," he said. "The attitude was, if it's worth doing, it's probably worth overdoing."

Outside a gated subdivision of mansions in McLean, a line of cars idles every weekday morning as a new day in Top Secret America gets underway. The drivers wait patiently to turn left, then crawl up a hill and around a bend to a destination that is not on any public map and not announced by any street sign.

Liberty Crossing tries hard to hide from view. But in the winter, leafless trees can't conceal a mountain of cement and windows the size of five Wal-Mart stores stacked on top of one another rising behind a grassy berm. One step too close without the right badge, and men in black jump out of nowhere, guns at the ready.

Past the armed guards and the hydraulic steel barriers, at least 1,700 federal employees and 1,200 private contractors work at Liberty Crossing, the nickname for the two headquarters of the Office of the Director of National Intelligence and its National Counterterrorism Center. The two share a police force, a canine unit and thousands of parking spaces.

Liberty Crossing is at the center of the collection of U.S. government agencies and corporate contractors that mushroomed after the 2001 attacks. But it is not nearly the biggest, the most costly or even the most secretive part of the 9/11 enterprise.

In an Arlington County office building, the lobby directory doesn't include the Air Force's mysteriously named XOIWS unit, but there's a big "Welcome!" sign in the hallway greeting visitors who know to step off the elevator on the third floor. In Elkridge, Md., a clandestine program hides in a tall concrete structure fitted with false windows to look like a normal office building. In Arnold, Mo., the location is across the street from a Target and a Home Depot. In St. Petersburg, Fla., it's in a modest brick bungalow in a run-down business park.

Each day at the National Counterterrorism Center in McLean, workers review at least 5,000 pieces of terrorist-related data from intelligence agencies and keep an eye on world events.

Every day across the United States, 854,000 civil servants, military personnel and private contractors with top-secret security clearances are scanned into offices protected by electromagnetic locks, retinal cameras and fortified walls that eavesdropping equipment cannot penetrate.



This is not exactly President Dwight D. Eisenhower's "military-industrial complex," which emerged with the Cold War and centered on building nuclear weapons to deter the Soviet Union. This is a national security enterprise with a more amorphous mission: defeating transnational violent extremists.



Much of the information about this mission is classified. That is the reason it is so difficult to gauge the success and identify the problems of Top Secret America, including whether money is being spent wisely. The U.S. intelligence budget is vast, publicly announced last year as $75 billion, 21/2 times the size it was on Sept. 10, 2001. But the figure doesn't include many military activities or domestic counterterrorism programs.



At least 20 percent of the government organizations that exist to fend off terrorist threats were established or refashioned in the wake of 9/11. Many that existed before the attacks grew to historic proportions as the Bush administration and Congress gave agencies more money than they were capable of responsibly spending.



The Pentagon's Defense Intelligence Agency, for example, has gone from 7,500 employees in 2002 to 16,500 today. The budget of the National Security Agency, which conducts electronic eavesdropping, doubled. Thirty-five FBI Joint Terrorism Task Forces became 106. It was phenomenal growth that began almost as soon as the Sept. 11 attacks ended.



Nine days after the attacks, Congress committed $40 billion beyond what was in the federal budget to fortify domestic defenses and to launch a global offensive against al-Qaeda. It followed that up with an additional $36.5 billion in 2002 and $44 billion in 2003. That was only a beginning.



With the quick infusion of money, military and intelligence agencies multiplied. Twenty-four organizations were created by the end of 2001, including the Office of Homeland Security and the Foreign Terrorist Asset Tracking Task Force. In 2002, 37 more were created to track weapons of mass destruction, collect threat tips and coordinate the new focus on counterterrorism. That was followed the next year by 36 new organizations; and 26 after that; and 31 more; and 32 more; and 20 or more each in 2007, 2008 and 2009.

In all, at least 263 organizations have been created or reorganized as a response to 9/11. Each has required more people, and those people have required more administrative and logistic support: phone operators, secretaries, librarians, architects, carpenters, construction workers, air-conditioning mechanics and, because of where they work, even janitors with top-secret clearances.

With so many more employees, units and organizations, the lines of responsibility began to blur. To remedy this, at the recommendation of the bipartisan 9/11 Commission, the George W. Bush administration and Congress decided to create an agency in 2004 with overarching responsibilities called the Office of the Director of National Intelligence (ODNI) to bring the colossal effort under control.

While that was the idea, Washington has its own ways.

The first problem was that the law passed by Congress did not give the director clear legal or budgetary authority over intelligence matters, which meant he wouldn't have power over the individual agencies he was supposed to control.

The second problem: Even before the first director, Ambassador John D. Negroponte, was on the job, the turf battles began. The Defense Department shifted billions of dollars out of one budget and into another so that the ODNI could not touch it, according to two senior officials who watched the process. The CIA reclassified some of its most sensitive information at a higher level so the National Counterterrorism Center staff, part of the ODNI, would not be allowed to see it, said former intelligence officers involved.

And then came a problem that continues to this day, which has to do with the ODNI's rapid expansion.


When it opened in the spring of 2005, Negroponte's office was all of 11 people stuffed into a secure vault with closet-size rooms a block from the White House. A year later, the budding agency moved to two floors of another building. In April 2008, it moved into its huge permanent home, Liberty Crossing.



Today, many officials who work in the intelligence agencies say they remain unclear about what the ODNI is in charge of. To be sure, the ODNI has made some progress, especially in intelligence-sharing, information technology and budget reform. The DNI and his managers hold interagency meetings every day to promote collaboration. The last director, Blair, doggedly pursued such nitty-gritty issues as procurement reform, compatible computer networks, tradecraft standards and collegiality.

But improvements have been overtaken by volume at the ODNI, as the increased flow of intelligence data overwhelms the system's ability to analyze and use it. Every day, collection systems at the National Security Agency intercept and store 1.7 billion e-mails, phone calls and other types of communications. The NSA sorts a fraction of those into 70 separate databases. The same problem bedevils every other intelligence agency, none of which have enough analysts and translators for all this work.



The practical effect of this unwieldiness is visible, on a much smaller scale, in the office of Michael Leiter, the director of the National Counterterrorism Center. Leiter spends much of his day flipping among four computer monitors lined up on his desk. Six hard drives sit at his feet. The data flow is enormous, with dozens of databases feeding separate computer networks that cannot interact with one another.



There is a long explanation for why these databases are still not connected, and it amounts to this: It's too hard, and some agency heads don't really want to give up the systems they have. But there's some progress: "All my e-mail on one computer now," Leiter says. "That's a big deal."



To get another view of how sprawling Top Secret America has become, just head west on the toll road toward Dulles International Airport.



As a Michaels craft store and a Books-A-Million give way to the military intelligence giants Northrop Grumman and Lockheed Martin, find the off-ramp and turn left. Those two shimmering-blue five-story ice cubes belong to the National Geospatial-Intelligence Agency, which analyzes images and mapping data of the Earth's geography. A small sign obscured by a boxwood hedge says so.

Across the street, in the chocolate-brown blocks, is Carahsoft, an intelligence agency contractor specializing in mapping, speech analysis and data harvesting. Nearby is the government's Underground Facility Analysis Center. It identifies overseas underground command centers associated with weapons of mass destruction and terrorist groups, and advises the military on how to destroy them.

Clusters of top-secret work exist throughout the country, but the Washington region is the capital of Top Secret America.



About half of the post-9/11 enterprise is anchored in an arc stretching from Leesburg south to Quantico, back north through Washington and curving northeast to Linthicum, just north of the Baltimore-Washington International Marshall Airport. Many buildings sit within off-limits government compounds or military bases.



Others occupy business parks or are intermingled with neighborhoods, schools and shopping centers and go unnoticed by most people who live or play nearby.


Many of the newest buildings are not just utilitarian offices but also edifices "on the order of the pyramids," in the words of one senior military intelligence officer.

Not far from the Dulles Toll Road, the CIA has expanded into two buildings that will increase the agency's office space by one-third. To the south, Springfield is becoming home to the new $1.8 billion National Geospatial-Intelligence Agency headquarters, which will be the fourth-largest federal building in the area and home to 8,500 employees. Economic stimulus money is paying hundreds of millions of dollars for this kind of federal construction across the region.

It's not only the number of buildings that suggests the size and cost of this expansion, it's also what is inside: banks of television monitors. "Escort-required" badges. X-ray machines and lockers to store cellphones and pagers. Keypad door locks that open special rooms encased in metal or permanent dry wall, impenetrable to eavesdropping tools and protected by alarms and a security force capable of responding within 15 minutes. Every one of these buildings has at least one of these rooms, known as a SCIF, for sensitive compartmented information facility. Some are as small as a closet; others are four times the size of a football field.

SCIF size has become a measure of status in Top Secret America, or at least in the Washington region of it. "In D.C., everyone talks SCIF, SCIF, SCIF," said Bruce Paquin, who moved to Florida from the Washington region several years ago to start a SCIF construction business. "They've got the penis envy thing going. You can't be a big boy unless you're a three-letter agency and you have a big SCIF."

SCIFs are not the only must-have items people pay attention to. Command centers, internal television networks, video walls, armored SUVs and personal security guards have also become the bling of national security.



"You can't find a four-star general without a security detail," said one three-star general now posted in Washington after years abroad. "Fear has caused everyone to have stuff. Then comes, 'If he has one, then I have to have one.' It's become a status symbol."



Among the most important people inside the SCIFs are the low-paid employees carrying their lunches to work to save money. They are the analysts, the 20- and 30-year-olds making $41,000 to $65,000 a year, whose job is at the core of everything Top Secret America tries to do.



At its best, analysis melds cultural understanding with snippets of conversations, coded dialogue, anonymous tips, even scraps of trash, turning them into clues that lead to individuals and groups trying to harm the United States.

Their work is greatly enhanced by computers that sort through and categorize data. But in the end, analysis requires human judgment, and half the analysts are relatively inexperienced, having been hired in the past several years, said a senior ODNI official. Contract analysts are often straight out of college and trained at corporate headquarters.

When hired, a typical analyst knows very little about the priority countries - Iraq, Iran, Afghanistan and Pakistan - and is not fluent in their languages. Still, the number of intelligence reports they produce on these key countries is overwhelming, say current and former intelligence officials who try to cull them every day. The ODNI doesn't know exactly how many reports are issued each year, but in the process of trying to find out, the chief of analysis discovered 60 classified analytic Web sites still in operation that were supposed to have been closed down for lack of usefulness. "Like a zombie, it keeps on living" is how one official describes the sites.

The problem with many intelligence reports, say officers who read them, is that they simply re-slice the same facts already in circulation. "It's the soccer ball syndrome. Something happens, and they want to rush to cover it," said Richard H. Immerman, who was the ODNI's assistant deputy director of national intelligence for analytic integrity and standards until early 2009. "I saw tremendous overlap."

Even the analysts at the National Counterterrorism Center (NCTC), which is supposed to be where the most sensitive, most difficult-to-obtain nuggets of information are fused together, get low marks from intelligence officials for not producing reports that are original, or at least better than the reports already written by the CIA, FBI, National Security Agency or Defense Intelligence Agency.



When Maj. Gen. John M. Custer was the director of intelligence at U.S. Central Command, he grew angry at how little helpful information came out of the NCTC. In 2007, he visited its director at the time, retired Vice Adm. John Scott Redd, to tell him so. "I told him that after 41/2 years, this organization had never produced one shred of information that helped me prosecute three wars!" he said loudly, leaning over the table during an interview.

Two years later, Custer, now head of the Army's intelligence school at Fort Huachuca, Ariz., still gets red-faced recalling that day, which reminds him of his frustration with Washington's bureaucracy. "Who has the mission of reducing redundancy and ensuring everybody doesn't gravitate to the lowest-hanging fruit?" he said. "Who orchestrates what is produced so that everybody doesn't produce the same thing?"

He's hardly the only one irritated. In a secure office in Washington, a senior intelligence officer was dealing with his own frustration. Seated at his computer, he began scrolling through some of the classified information he is expected to read every day: CIA World Intelligence Review, WIRe-CIA, Spot Intelligence Report, Daily Intelligence Summary, Weekly Intelligence Forecast, Weekly Warning Forecast, IC Terrorist Threat Assessments, NCTC Terrorism Dispatch, NCTC Spotlight . . .

It's too much, he complained. The inbox on his desk was full, too. He threw up his arms, picked up a thick, glossy intelligence report and waved it around, yelling.

"Jesus! Why does it take so long to produce?"

"Why does it have to be so bulky?"

"Why isn't it online?"

The overload of hourly, daily, weekly, monthly and annual reports is actually counterproductive, say people who receive them. Some policymakers and senior officials don't dare delve into the backup clogging their computers. They rely instead on personal briefers, and those briefers usually rely on their own agency's analysis, re-creating the very problem identified as a main cause of the failure to thwart the attacks: a lack of information-sharing.

The ODNI's analysis office knows this is a problem. Yet its solution was another publication, this one a daily online newspaper, Intelligence Today. Every day, a staff of 22 culls more than two dozen agencies' reports and 63 Web sites, selects the best information and packages it by originality, topic and region.

Analysis is not the only area where serious overlap appears to be gumming up the national security machinery and blurring the lines of responsibility.

Within the Defense Department alone, 18 commands and agencies conduct information operations, which aspire to manage foreign audiences’ perceptions of U.S. policy and military activities overseas.

And all the major intelligence agencies and at least two major military commands claim a major role in cyber-warfare, the newest and least-defined frontier.

"Frankly, it hasn't been brought together in a unified approach," CIA Director Panetta said of the many agencies now involved in cyber-warfare.

"Cyber is tremendously difficult" to coordinate, said Benjamin A. Powell, who served as general counsel for three directors of national intelligence until he left the government last year. "Sometimes there was an unfortunate attitude of bring your knives, your guns, your fists and be fully prepared to defend your turf." Why? "Because it's funded, it's hot and it's sexy."

Last fall, U.S. Army Maj. Nidal Malik Hasan allegedly opened fire at Fort Hood, Tex., killing 13 people and wounding 30. In the days after the shootings, information emerged about Hasan's increasingly strange behavior at Walter Reed Army Medical Center, where he had trained as a psychiatrist and warned commanders that they should allow Muslims to leave the Army or risk "adverse events." He had also exchanged e-mails with a well-known radical cleric in Yemen being monitored by U.S. intelligence.

But none of this reached the one organization charged with handling counterintelligence investigations within the Army. Just 25 miles up the road from Walter Reed, the Army's 902nd Military Intelligence Group had been doing little to search the ranks for potential threats. Instead, the 902's commander had decided to turn the unit's attention to assessing general terrorist affiliations in the United States, even though the Department of Homeland Security and the FBI's 106 Joint Terrorism Task Forces were already doing this work in great depth.



The 902nd, working on a program the commander named RITA, for Radical Islamic Threat to the Army, had quietly been gathering information on Hezbollah, Iranian Republican Guard and al-Qaeda student organizations in the United States. The assessment "didn't tell us anything we didn't know already," said the Army's senior counterintelligence officer at the Pentagon.

Secrecy and lack of coordination have allowed organizations, such as the 902nd in this case, to work on issues others were already tackling rather than take on the much more challenging job of trying to identify potential jihadist sympathizers within the Army itself.

Beyond redundancy, secrecy within the intelligence world hampers effectiveness in other ways, say defense and intelligence officers. For the Defense Department, the root of this problem goes back to an ultra-secret group of programs for which access is extremely limited and monitored by specially trained security officers.

These are called Special Access Programs - or SAPs - and the Pentagon's list of code names for them runs 300 pages. The intelligence community has hundreds more of its own, and those hundreds have thousands of sub-programs with their own limits on the number of people authorized to know anything about them. All this means that very few people have a complete sense of what's going on.

"There's only one entity in the entire universe that has visibility on all SAPs - that's God," said James R. Clapper, undersecretary of defense for intelligence and the Obama administration's nominee to be the next director of national intelligence.

Such secrecy can undermine the normal chain of command when senior officials use it to cut out rivals or when subordinates are ordered to keep secrets from their commanders.

One military officer involved in one such program said he was ordered to sign a document prohibiting him from disclosing it to his four-star commander, with whom he worked closely every day, because the commander was not authorized to know about it. Another senior defense official recalls the day he tried to find out about a program in his budget, only to be rebuffed by a peer. "What do you mean you can't tell me? I pay for the program," he recalled saying in a heated exchange.

Another senior intelligence official with wide access to many programs said that secrecy is sometimes used to protect ineffective projects. "I think the secretary of defense ought to direct a look at every single thing to see if it still has value," he said. "The DNI ought to do something similar."

The ODNI hasn't done that yet. The best it can do at the moment is maintain a database of the names of the most sensitive programs in the intelligence community. But the database does not include many important and relevant Pentagon projects.

Because so much is classified, illustrations of what goes on every day in Top Secret America can be hard to ferret out. But every so often, examples emerge. A recent one shows the post-9/11 system at its best and its worst.

Last fall, after eight years of growth and hirings, the enterprise was at full throttle when word emerged that something was seriously amiss inside Yemen. In response, President Obama signed an order sending dozens of secret commandos to that country to target and kill the leaders of an al-Qaeda affiliate.

In Yemen, the commandos set up a joint operations center packed with hard drives, forensic kits and communications gear. They exchanged thousands of intercepts, agent reports, photographic evidence and real-time video surveillance with dozens of top-secret organizations in the United States.

That was the system as it was intended. But when the information reached the National Counterterrorism Center in Washington for analysis, it arrived buried within the 5,000 pieces of general terrorist-related data that are reviewed each day. Analysts had to switch from database to database, from hard drive to hard drive, from screen to screen, just to locate what might be interesting to study further.

As military operations in Yemen intensified and the chatter about a possible terrorist strike increased, the intelligence agencies ramped up their effort. The flood of information into the NCTC became a torrent.

Somewhere in that deluge was even more vital data. Partial names of someone in Yemen. A reference to a Nigerian radical who had gone to Yemen. A report of a father in Nigeria worried about a son who had become interested in radical teachings and had disappeared inside Yemen.

These were all clues to what would happen when a Nigerian named Umar Farouk Abdulmutallab left Yemen and eventually boarded a plane in Amsterdam bound for Detroit. But nobody put them together because, as officials would testify later, the system had gotten so big that the lines of responsibility had become hopelessly blurred.

"There are so many people involved here," NCTC Director Leiter told Congress.

"Everyone had the dots to connect," DNI Blair explained to the lawmakers. "But I hadn't made it clear exactly who had primary responsibility."

And so Abdulmutallab was able to step aboard Northwest Airlines Flight 253. As it descended toward Detroit, he allegedly tried to ignite explosives hidden in his underwear. It wasn't the very expensive, very large 9/11 enterprise that prevented disaster. It was a passenger who saw what he was doing and tackled him. "We didn't follow up and prioritize the stream of intelligence," White House counterterrorism adviser John O. Brennan explained afterward. "Because no one intelligence entity, or team or task force was assigned responsibility for doing that follow-up investigation."

Blair acknowledged the problem. His solution: Create yet another team to run down every important lead. But he also told Congress he needed more money and more analysts to prevent another mistake.

More is often the solution proposed by the leaders of the 9/11 enterprise. After the Christmas Day bombing attempt, Leiter also pleaded for more - more analysts to join the 300 or so he already had.

The Department of Homeland Security asked for more air marshals, more body scanners and more analysts, too, even though it can't find nearly enough qualified people to fill its intelligence unit now. Obama has said he will not freeze spending on national security, making it likely that those requests will be funded.

More building, more expansion of offices continues across the country. A $1.7 billion NSA data-processing center will be under construction soon near Salt Lake City. In Tampa, the U.S. Central Command’s new 270,000-square-foot intelligence office will be matched next year by an equally large headquarters building, and then, the year after that, by a 51,000-square-foot office just for its special operations section.

Just north of Charlottesville, the new Joint-Use Intelligence Analysis Facility will consolidate 1,000 defense intelligence analysts on a secure campus.

Meanwhile, five miles southeast of the White House, the DHS has broken ground for its new headquarters, to be shared with the Coast Guard. DHS, in existence for only seven years, already has its own Special Access Programs, its own research arm, its own command center, its own fleet of armored cars and its own 230,000-person workforce, the third-largest after the departments of Defense and Veterans Affairs.

Soon, on the grounds of the former St. Elizabeths mental hospital in Anacostia, a $3.4 billion showcase of security will rise from the crumbling brick wards. The new headquarters will be the largest government complex built since the Pentagon, a major landmark in the alternative geography of Top Secret America and four times as big as Liberty Crossing.

TSA to swab airline passengers' hands in search for explosives

Washington (CNN) -- To the list of instructions you hear at airport checkpoints, add this: "Put your palms forward, please."

The Transportation Security Administration soon will begin randomly swabbing passengers' hands at checkpoints and airport gates to test them for traces of explosives.

Previously, screeners swabbed some carry-on luggage and other objects as they searched for the needle in the security haystack -- components of terrorist bombs in an endless stream of luggage.

But after the Christmas Day attempted bombing of Northwest Flight 253 over Detroit, Michigan, the TSA began a program of swabbing passengers' hands, which could be contaminated by explosive materials, experts say. The TSA will greatly expand the swabbing in the coming weeks, the agency said.

"The point is to make sure that the air environment is a safe environment," Homeland Security Secretary Janet Napolitano told CNN. "We know that al Qaeda [and other] terrorists continue to think of aviation as a way to attack the United States. One way we keep it safe is by new technology [and] random use of different types of technology."

Security experts consulted by CNN said swabbing hands is a good move, and privacy advocates said they support the new swabbing protocols, provided the agency tests only for security-related objects and does not discriminate when it selects people to be tested.

It's a "very good idea," said security expert Tony Fainberg. TSA screeners currently swab luggage handles and parts of bags that are likely be contaminated by human hands, he said, and swabbing a person's hands increases the chances of finding explosive materials. "Looking at the hands means you will probably get a better dose," he said.

Under the new protocols, tests will be conducted at various locations -- including in checkpoint lines, during the screening process and at gates. Newer, more portable machines make it easier to conduct tests away from fixed locations such as the checkpoint.

The TSA has more than 7,000 explosive trace detection (ETD) machines and has purchased 400 additional units with $16 million in federal stimulus money. The president's fiscal 2011 budget calls for $60 million to purchase approximately 800 portable ETD machines.

Napolitano said the tests will not significantly increase wait times at airport checkpoints.

The American Civil Liberties Union has "always supported explosive detection as a good form of security that doesn't really invade privacy," said Jay Stanley, an attorney and privacy expert with the organization.

Stanley said the ACLU is chiefly concerned that the TSA does not discriminate when selecting people for enhanced screening -- something the agency said it does not do -- and that it treat people with dignity.

"We would not want to see it implemented in a discriminatory fashion, for example, in a disproportionate way against Muslims and Arabs or, for example, people with red hair or anything else. Security experts from across the spectrum will tell you that that's not just unfair and unjust and not the American way, it's also a terrible way to do security," Stanley said.

Swabbing also should not be used to test for nonsecurity-related contraband, such as drugs, he said. "Under the Constitution, searches in airports are only for the purpose of protecting the security of airline transportation; they are not general law enforcement stops. And so it wouldn't be permissible for the government to use these trace portal detectors to look for drugs," Stanley said.

The TSA said the machines test only for explosives. It declined to specify which explosives, citing security reasons.

Because some legal substances -- such as fertilizers and heart medicines -- can result in "false positives," Stanley said the ACLU also wants to ensure that people who test positive be treated respectfully.

"It's important that the government treat people who do show up as a positive -- fairly and with dignity -- and not parade them off in handcuffs and treat them as terrorists, but do rational things to investigate what the problem might be," he said.

But swabbing hands does not, by itself, raise civil liberty problems, Stanley said. "There's really not a big privacy interest at stake here," he said. "They are basically looking for particles of explosives, which is not something that people normally have."

WASHINGTON (AP) - The Obama administration is firing back at Sen. Jon Kyl for calling for an end to economic stimulus spending, and they're aiming for where it hurts the most - at home in Arizona.

The White House on Tuesday released letters from four cabinet secretaries to Arizona Gov. Jan Brewer, a Republican, citing Kyl's comments and outlining transportation, housing, Indian education and other projects in his home state they said would be eliminated if the senator has his way.

Kyl, the No. 2 Senate GOP leader, has said the stimulus spending hasn't succeeded in boosting the economy and that it's adding to the deficit. He's suggested on his Senate Web site and in interviews that spending not already allocated be halted.

Transportation Secretary Ray LaHood, one of two Republicans in Obama's cabinet, made no attempt to conceal his needling.

Kyl "publicly questioned whether the stimulus is working and stated that he wants to cancel projects that aren't presently under way," LaHood wrote Brewer. "If you prefer to forfeit the money we are making available to your state, as Senator Kyl suggests, please let me know."
LaHood noted in the letter that at least $520.9 million of the $48 billion for transportation projects under the economic recovery act are intended for Arizona projects, including transit projects in Phoenix.

Agriculture Secretary Tom Vilsack said Arizona would lose $45 million for 500 single-family housing loans if projects not already under way were canceled. Housing and Urban Development Secretary Shaun Donovan said the state would forfeit $73 million his department oversees, including $22 million for homeless programs.

Interior Secretary Ken Salazar, a Westerner who formerly served with Kyl in the Senate, didn't mention the Arizonan by name in his letter, but referred to "some key Republican leaders in Congress." He said the state would lose $60 million for Bureau of Indian Education schools, among other money.

Brewer spokesman Paul Senseman said the governor wants Arizona taxpayers to "receive their fair share" of any stimulus dollars.

"We certainly hope that they're somehow not threatening Arizona's portion of federal funding based on their disagreement with Senator Kyl," Senseman said.

Phoenix mayor Phil Gordon, a Democrat, said he called Brewer's office requesting that the governor continue to accept stimulus money. He also sent letters to cabinet officials volunteering Phoenix to act as a fiduciary for all Arizona stimulus funds if Brewer were to turn them down.

"The Senator is 2,000 miles away," Gordon said at a news conference Tuesday. "We're here trying to build roads and put people to work."

Kyl didn't immediately reply to a request for comment from The Associated Press.
The president of the Arizona Chamber of Commerce and Industry came to Kyl's defense, however, posting a column Tuesday on the chamber's Web site under the headline: "Don't Bully Arizona."

"It is one thing to joust with Senator Kyl over his position, but it is an entirely different matter for Cabinet secretaries to write letters to the chief executive of a state and threaten funding if support isn't provided," wrote Glen Hamer.

On Sunday, Kyl said of stimulus spending that "the reality is it hasn't helped yet." He said it may be years before all the money gets spent and that the economy could recover before then.
"Only about 6.8 percent of the money has actually been spent. What I proposed is, after you complete the contracts that are already committed, the things that are in the pipeline, stop it," Kyl told ABC's "This Week."

Last week, Kyl argued in a column posted on his Senate Web site that the economic stimulus program has been a failure. He said he agreed with those who "want to cancel the rest of the stimulus spending."

Can someone please tell us how U. S. Secretary of Homeland Security Janet Napolitano got her job? She appears to be about as knowledgeable about border issues as a late-night radio call-in yahoo.

In an interview broadcast Monday on the CBC, Ms. Napolitano attempted to justify her call for stricter border security on the premise that "suspected or known terrorists" have entered the U. S. across the Canadian border, including the perpetrators of the 9/11 attack.

All the 9/11 terrorists, of course, entered the United States directly from overseas. The notion that some arrived via Canada is a myth that briefly popped up in the wake of the 9/11 attacks, and was then quickly debunked.

Informed of her error, Ms. Napolitano blustered: "I can't talk to that. I can talk about the future. And here's the future. The future is we have borders."

One country at a time - our friends list is shortened. I recall, during the campaign - the attack on bush included - he has alienated our friends, and on january 20, I will let the world know we are back, and willing to mend fences.

U.S. security boss clarifies comments about border

The U.S. Homeland Security chief has clarified earlier remarks that suggested the 9-11 terrorists entered the U.S. through Canada.

Homeland Security Secretary Janet Napolitano made the comments during a media interview earlier this week, much to the chagrin of Canadians on both sides of the border.

In a release Tuesday night following the interview, she called Canada a "close ally and an important partner" and said she was simply misunderstood.

"I know that the September 11th hijackers did not come through Canada to the United States," she said in the statement.

"There are other instances, however, when suspected terrorists have attempted to enter our country from Canada to the United States. Some of these are well-known to the public -- such as the Millennium Bomber -- while others are not due to security reasons."

Ottawa rushed to defend its border security on Tuesday amid the diplomatic scuffle that broke out over Napolitano's earlier remarks.

In recent years, Ottawa has invested a great deal of effort into dispelling perceptions among Americans that Canada's border is an easy entry point for terrorists planning attacks on U.S. soil.

"Unfortunately, misconceptions arise on something as fundamental as where the 9-11 terrorists came from," said Michael Wilson, Canada's ambassador in Washington.

"As the 9-11 commission reported in 2004, all of the 9-11 terrorists arrived in the United States from outside North America. They flew to major U.S. airports. They entered the U.S. with documents issued by the United States government and no 9-11 terrorists came from Canada."

Wilson, who was the keynote speaker at the Border Trade Alliance meeting in Washington on Tuesday, said Napolitano's staff attempted to tamp down the controversy by blaming the comments on a simple misunderstanding.

"Her comment from her people is that she misunderstood," Wilson said, adding that he was planning a personal meeting with Napolitano in the near future.

The furor began when Napolitano was asked to clarify statements she had made about equal treatment for the Mexican and Canadian borders, despite the fact that a flood of illegal immigrants and a massive drug war are two serious issues on the southern border.

"Yes, Canada is not Mexico, it doesn't have a drug war going on, it didn't have 6,000 homicides that were drug-related last year," she said.

"Nonetheless, to the extent that terrorists have come into our country or suspected or known terrorists have entered our country across a border, it's been across the Canadian border. There are real issues there."

When asked if she was referring to the 9-11 terrorists, Napolitano added: "Not just those but others as well."

Jane Harman: Democrat, Change and all that jazz

Republicans are usually the unlucky recipient of a camera or recorder catching them saying something dumb, or opening the door to leave an apartment that is not their ....

Democrats, when they are caufght, are usually commiting more serious offenses.

This is CHANGE? I'd much prefer the bumbling of Republicans to violations of the sort she has 'waddled into'.

Rep. Jane Harman , the California Democrat with a longtime involvement in intelligence issues, was overheard on an NSA wiretap telling a suspected Israeli agent that she would lobby the Justice Department reduce espionage-related charges against two officials of the American Israeli Public Affairs Committee, the most powerful pro-Israel organization in Washington.

Harman was recorded saying she would "waddle into" the AIPAC case "if you think it'll make a difference," according to two former senior national security officials familiar with the NSA transcript.

In exchange for Harman's help, the sources said, the suspected Israeli agent pledged to help lobby Nancy Pelosi , D-Calif., then-House minority leader, to appoint Harman chair of the Intelligence Committee after the 2006 elections, which the Democrats were heavily favored to win.

Seemingly wary of what she had just agreed to, according to an official who read the NSA transcript, Harman hung up after saying, "This conversation doesn't exist."

Harman declined to discuss the wiretap allegations, instead issuing an angry denial through a spokesman.

Homeland Security Secretary Janet Napolitano said she was briefed before the release of a controversial intelligence assessment and that she stands by the report sent to law enforcement that lists veterans as a terrorist risk to the U.S. and defines "rightwing extremism" as including groups opposed to abortion and immigration.

The outcry resulted in a demand from the head of the American Legion to meet with Ms. Napolitano, a request the DHS chief said she would honor next week when she returns to Washington from her current tour of the U.S.-Mexican border.

"The document on right-wing extremism sent last week by this department´s Office of Intelligence and Analysis is one in an ongoing series of assessments to provide situational awareness to state, local and tribal law enforcement agencies on the phenomenon and trends of violent radicalization in the United States," Ms. Napolitano said in a statement.
