Recently, an 11 year old (I believe the age is correct) killed his father's girlfriend/wife - she was 8-9 months pregnant. The prosecutor wants to charge the kid as an adult. Did the kid know (mentally) what he was doing, the consequences of his actions - probably, but we could argue that he should be sent to a mental hospital for 7+ years and then spend some time in jail.
A 9 year old boy killed his father and a male roommate. This was some time ago, but the kid was found after he shot the roommate and father at their home. Mental issues - clearly. Should he be tried as an adult - no. Mental war - yes. Jail - perhaps.
A group of 9 and 11 year olds (4 of them) rape an elderly woman. Should they be held responsible as adults - possibly. Jail - certainly. Are they mentally ill - no.
I think I have made clear where I stand on charging children or people who may be mentally unstable.

Canada judge: Man not responsible for beheading

WINNIPEG, Manitoba – A Canadian judge ruled Thursday that a man accused of beheading and cannibalizing a fellow Greyhound bus passenger is not criminally responsible due to mental illness. The decision means Chinese immigrant Vince Li will be treated in a mental institution instead of going to prison. The family of victim Tim McLean said Li got away with murder.
"A crime was still committed here, a murder still occurred," said Carol deDelley, McLean's mother. "There was nobody else on that bus holding a knife, slicing up my child."
Li stabbed McLean dozens of times and dismembered his body last July while horrified passengers fled.
Justice John Scurfield said the attack was "barbaric" but "strongly suggestive of a mental disorder."
"He did not appreciate the actions he committed were morally wrong," Scurfield said.
Both the prosecution and the defense argued Li can't be held responsible because he had schizophrenia and believed God wanted him to kill McLean because the young man was evil.
Li will be institutionalized without a criminal record and reassessed every year by a mental health review board to determine if he is fit for release.

To the dozen or so Canadians who will read this - this decision is NOT more just, more fair, kinder, gentler, more compassionate. It is stupid. It values life LESS than it values feelings. Justice is subverted by this process not ensconced in any citadel of justice and equity. I do not advocate killing off the mentally stupid and or evil ... I do support the idea of caging them, where they can do no more harm. Evil is not helped with psychology. That is unfortunately what secularism misses - it cannot and must not accept evil as existing, for to do so accepts the religious. instead, it is simply human actions - good, bad, lacking judgment, poor judgment ...
You dishonor the dead. You trample upon justice and spit in her face.
That apparently is the way of the left - whether in Canada or Europe.
